Former US chief infectious disease official Anthony Fauci invoked his constitutional right against self-incrimination during a Senate hearing on Wednesday, refusing to answer hostile questions from Republican Senator Rand Paul regarding the origins of COVID-19.
At the outset of the hearing, Paul launched fierce attacks on Fauci, reiterating claims that during Fauci’s tenure as director of the National Institute of Allergy and Infectious Diseases (NIAID), the US funded China’s so-called “gain of function” research, which he alleges led to the spread of the COVID-19 pandemic. Paul insists Fauci has concealed information from Congress and lied, but Fauci has repeatedly denied these allegations.
Before Fauci’s appearance at the hearing, more than 150 scientists, physicians, and public health advocates jointly signed an open letter urging members of Congress to “stop the ongoing vilification and harassment of scientists,” and denouncing the accusations against Fauci as “absurd.”
Paul, chairman of the Senate Homeland Security and Governmental Affairs Committee, is a longtime adversary of the now 85-year-old Fauci, who retired in 2022. Fauci accused Paul of launching a “maniacal” campaign to put him in jail, and refused to answer over 100 questions at the hearing.
Fauci invoked the Fifth Amendment of the US Constitution to remain silent and avoid self-incrimination, adding that his lawyers believed Paul’s intent was to lure him into a misstatement and potentially trigger perjury charges. When Fauci’s lawyer attempted to speak on his behalf, Paul ordered the lawyer removed from the hearing.
Paul stated that Fauci had no right to invoke the Fifth Amendment to refuse to answer senators’ questions, and that the pardon granted by President Biden could not provide protection. Biden’s pardon does not extend to events occurring after the pardon was issued.
In his opening statement, Fauci said that over the past 40 years he has testified before Congress more than 200 times, “I have demonstrated my belief in and respect for the value of legitimate congressional oversight.”
Fauci previously led the National Institute of Allergy and Infectious Diseases (NIAID) for 38 years, spanning administrations of both Republican and Democratic presidents, and later became the face of America’s fight against the COVID pandemic.
During the pandemic, Fauci was heavily criticized for advocating lockdowns, mask wearing, and social distancing. His guidance on vaccines made him a particular target of criticism. Although vaccines have been shown to be safe and effective, the issue of vaccination was highly politicized during the pandemic.
