(Bandar Seri Begawan, 24th) The National Immigration and Registration Department (NIRD), in cooperation with other law enforcement agencies, continues to actively carry out comprehensive enforcement operations to severely crack down on violations of immigration laws.
The enforcement departments of the NIRD and Ministry of Labour jointly conducted a comprehensive operation numbered Panyap 110/2025, focusing on combating a commercial company located in Mukim Sengkurong.
During the operation, five foreign nationals were examined, with one required to report to the enforcement department of the NIRD for further investigation, as he is suspected of violating Chapter 17, Section 15(3) of the Immigration Regulation, namely, not working in the position stated in his passport.
At the same time, the enforcement units of the Ministry of Labour found three violations during the operation. The first offense is under Section 112(1), that is, employing foreign workers without holding a license issued by the Commissioner of Labour; the second offense is under Section 112(2), namely, violating the conditions of the license for hiring foreign workers; the third offense is under Section 86, which is failing to declare the business location to the Ministry of Labour.
To continue combating immigration offenders, the Enforcement Team of the Joint Enforcement Bureau’s Kuala Belait branch has also conducted an operation code-named Panyap 112/2025, targeting foreign workers' residences located in Mukim Liang.
Nine foreign nationals were checked, of whom seven were detained and handed over to the enforcement team for further investigation.
According to reports, two of these foreigners absconded from their employers and are believed to have violated Chapter 17, Section 15(1) of the Immigration Law, namely, overstaying after their immigration passes were revoked.
Five others violated Sections 55(4)(a)(b)(c) of Chapter 17 of the Immigration Law, that is, failing to present any valid documents, and are believed to have violated Chapter 17, Section 15(1) of the Immigration Law—overstaying after their immigration passes were revoked.
At the same time, two foreign nationals were also ordered to report to the enforcement department for further investigation, as they are suspected of violating Chapter 17, Section 15(3) of the Immigration Regulation, namely, engaging in work different from that stated in their passports.
The bureau also shared two prosecution cases under Chapter 17 of the Immigration Law.
Prosecution against Edwin Yun Kok Kim @ Md. Yazid Abdullah, a 49-year-old Malaysian male citizen, was a court handover case by the Royal Brunei Police Force.
The suspect was convicted of two offenses: the first offense is under Section 380 of Chapter 22 of the Penal Code (theft); the second offense is under Section 36 of Chapter 17 of the Immigration Law (re-entering the country after being legally deported or repatriated).
The suspect pleaded guilty and was sentenced to eight months imprisonment for the first offense, and two years and nine months imprisonment and three strokes of the cane for the second offense. Both sentences are to be served consecutively, with a total sentence of three years and five months imprisonment and three strokes of the cane. The sentence is effective from the date of his arrest, which is October 8, 2025.
Meanwhile, 31-year-old Bangladeshi national Muhammad Babur Hossain admitted to violating Chapter 17, Section 15(1) of the Immigration Law, namely overstaying after his immigration pass was revoked, and was sentenced to three months’ imprisonment and three strokes of the cane. This sentence will take effect on October 7, 2025.
