In Kaohsiung, Taiwan, a public display of sexual activity was witnessed in a park's children's play area. The two people involved, a 72-year-old man and a 67-year-old woman, became carried away, engaging in sexual acts by the slide, and were photographed by a parent. The elderly man, who allegedly paid the woman 200 New Taiwan Dollars (about 28 RM) for 'outdoor sex', was found guilty of public indecency and sentenced to 40 days of detention, convertible into a fine; the verdict is open to appeal.
According to Taiwanese media reports, this outrageous morality case happened at around 3 pm on August 24 last year. Ms. Liang had brought her child to play at the children’s play area next to Exit 2 of the Fengshan Gymnasium parking lot, and saw a man and woman being intimate under the slide. The man was lying below, the woman was sitting on top of him, and neither was wearing pants. Ms. Liang, shocked, quickly took her child away, then took photos and reported the incident to the police.
The elderly man, nicknamed A-Long, and the woman, nicknamed A-Fen, were both charged with the crime of co-committing public indecency. A-Long denied having sex with A-Fen or paying her money, arguing he was lying on the ground only because children were playing, so he lay inside the slide. Later, A-Fen approached him asking for money, 'I didn’t give her money, I didn’t want to have sex with her, I only gave her food to eat,' he said.
In her police statement, A-Fen admitted that, at A-Long's request, she removed her pants, and he kept touching her breasts. 'But because he couldn’t get an erection, even after several attempts we couldn’t successfully have intercourse, but our genitals did come into contact,' she stated.
The Kaohsiung District Court judge assessed the witness testimony, photos, and A-Fen's statement, and stated that A-Long had carried out indecent acts in public, allowing those present to witness it, affecting social morals, and that his actions were clearly inappropriate. Considering the means, circumstances of the crime, his denial of guilt, and taking into account his knowledge, economic, and family situation, A-Long was ultimately found guilty of co-committing public indecency, sentenced to 40 days detention, convertible into a fine at the rate of 1,000 NTD (about 138 RM) per day. The case is open to appeal.
