The Attorney General's Office's appeal application regarding the former Prime Minister Datuk Seri Najib's supplemental order for home detention, will be decided by the Federal Court tomorrow.
Led by the Chief Judge of Malaya, Datuk Seri Hasnah Hashim, and including Federal Court judges Datuk Zabariah and Datuk Hanipah, the three-judge panel of the Federal Court will make the decision at 9 am tomorrow.
The Court of Appeal, on January 6 this year, approved Najib's appeal for judicial review regarding the home detention supplemental order and referred the case back to the Kuala Lumpur High Court for trial.
This decision overturned the previous judgment of the High Court, which dismissed Najib's judicial review appeal regarding the home detention supplemental order.
71-year-old Najib filed for a judicial review order last year, requesting the respondents, including the Minister of Home Affairs, the Director General of Prisons, and the Attorney General, to respond and verify the existence of this supplemental order dated January 29, 2024.
Najib also requested that if the supplemental order exists, all or any one of the respondents must immediately execute it and transfer the applicant from Kajang Prison to his residence in Kuala Lumpur to complete the remaining sentence through home detention.
On August 23, 2022, Najib was sentenced to 12 years in prison and fined RM210 million for misappropriating funds from SRC International Sdn Bhd and is currently serving his sentence in Kajang Prison.
The Pardon Board announced on February 2 last year that Najib's sentence was halved, reducing the imprisonment from 12 years to 6 years and the fine from RM210 million to RM50 million, which means Najib could be released as early as August 23, 2028.
