(Brunei 16th) Two local women admitted in the Magistrate's Court yesterday to violating the 2004 Employment Agencies Act, confessing to operating an employment agency service without a license and abusing employment agency regulations.
The defendant, Dailama (67 years old), admitted to operating an employment agency without a license between October 2023 and January 2024, and was fined BND 1,000, or faced one month's imprisonment for failing to pay.
Meanwhile, the owner of the Suyanti Shaji Employment Agency, Suyanti (56 years old), admitted to lending her employment agency to Dailama during the same period, and was fined BND 2,000, or faced two months' imprisonment for failing to pay.
The court learned that defendant Dailama used another defendant Suyanti's manual to assist in recruiting interviews for domestic workers and a driver. She coordinated with an employment agency’s interviewer, shared personal details of potential recruits, and organized the required documents.
She received a total remuneration of BND 9,000, with BND 3,000 paid in cash and BND 6,000 transferred via bank, issuing receipts herself. She earned a commission of BND 200 from each worker, with the remaining amount used to pay admission fees and service charges.
The investigation confirmed that Dailama's actions were in violation of the 2004 Employment Agencies Act. She was charged under Section 6(1), which carries a maximum penalty of a BND 5,000 fine, one year of imprisonment, or both.
The other defendant, Suyanti, admitted to storing coffin and documents for Dailama, using these documents to submit an application to the factory department last night. Suyanti received two service fees of BND 500 each.
This act violated Section 31(f) of the Act, which prohibits a licensed holder from lending their freight agency to others.
Both defendants have no previous convictions.
