Selling E-Cigarettes on Facebook Prosecuted, Miri Court Fines RM3,200

(Miri, 13th) — A person pleaded guilty in the Second Magistrate's Court in Miri to promoting e-cigarette products via social media, and was fined RM3,200 or in default, three months' imprisonment. The fine has been fully paid.

The Miri Health Department stated in a press release yesterday that the case was concluded on the 11th of this month. The accused violated the Control of Tobacco Product for Public Health Act 2024 (Act 852) by promoting e-cigarette flavors and devices on the Facebook platform.

The authorities reported that the case originated from a public complaint. Enforcement officers subsequently conducted an investigation, during which they found that the e-cigarette products displayed at the scene matched those promoted in a screenshot of the social media post dated September 30, 2025, providing solid evidence.

Based on the investigation, enforcement officers issued a court summons to the owner of the relevant Facebook account, citing Section 9(1) of the Act. The accused pleaded guilty to the charges in court, and the court thus delivered the above sentence.

The Health Department emphasized that under Section 9(3)(a)(i) of the Act, anyone found guilty is liable to a maximum fine of RM20,000, or imprisonment for up to one year, or both.

The authorities have stated clearly that they will not tolerate any form of promotion of smoking products via social media or any other platforms, and will continue to step up enforcement actions, prosecuting offenders in accordance with the law without compromise. The public is also urged to immediately stop all promotional activities involving e-cigarettes or related smoking products, as violators will face strict legal punishment.
