Laborer Sentenced to 5 Years’ Jail and 2 Strokes of the Cane for Third Drug Offense

(Kuching, 26th) A 37-year-old laborer has been sentenced to 5 years’ imprisonment and 2 strokes of the cane by the Magistrate’s Court today after being found guilty of self-administering dangerous drugs for the third time.
The accused, Mohamad Sharizzin Mohamad Tanlin, pleaded guilty before Judge Musli Ab Hamid.
He was charged under Section 15(1)(a) of the Dangerous Drugs Act 1952, and as a repeat offender, was sentenced under Section 39C(1)(b) of the same Act.
The court also ordered, pursuant to Section 38B of the Act, that the accused must undergo police supervision for two years at the Kuching National Anti-Drugs Agency (AADK) upon completing his sentence.
According to the case facts, the accused committed the offense at about 11:50 am on March 22, 2024, at the Narcotics Crime Investigation Office of the Kuching District Police.
The court learned that, after arresting Mohamad Sharizzin, police conducted a urine test. The initial screening showed positive results for amphetamine and methamphetamine.
Subsequently, analysis reports from the Department of Pathology’s Drug Testing Laboratory at Sarawak General Hospital confirmed the urine sample contained these two substances, both of which are listed in the First Schedule of the Dangerous Drugs Act 1952.
Investigations also revealed that the accused had been convicted twice before, on July 1, 2020, and November 30, 2021, under the same section.
Given his criminal record, the prosecution invoked Section 39C(1)(b), which provides for a maximum sentence of 7 years’ imprisonment and up to 3 strokes of the cane.
The case was prosecuted by Deputy Public Prosecutor Ruvenasini Pandian, while the accused had no legal representation.
