An Indian national in Taiwan, in the early morning of January 12th last year around 5 a.m., encountered a woman with long flowing hair on the street. He proceeded to follow her all the way to her apartment, and upon entering discovered the person was actually a man dressed as a woman, known as a 'cross-dresser.' The Indian man, thinking, 'since I'm already here,' forced the victim to perform oral sex and at one point attempted to forcibly have intercourse. In both first and second trials, the judges found him guilty of forced intercourse and sentenced him to 8 years and 6 months in prison.
According to a report by United Daily News on the 4th, the case occurred in Kaohsiung. The verdict stated that on January 12th last year at around 5 a.m., the Indian man, who was working in Taiwan, randomly met a man wearing women's clothing and made-up like a woman on the street. Driven by lust, he followed the person all the way back to a rented apartment in the Qianjin District. The man did not suspect anything when the Indian man entered the elevator with him. After reaching the suite's floor, the Indian man pretended that he was there to see a roommate renting another suite, tricked the man into opening the door, and then forcibly entered.
Upon entering, the Indian man immediately revealed his true intentions: first, forcefully grabbing the victim's hair and pushing down his head. Even after discovering that the victim was a 'cross-dresser,' the Indian man did not stop and forced the man to perform oral sex on him. The victim ran back to his room, but the Indian man followed, and despite the victim's repeated shouts of 'NO! NO, NO!', he forced him to turn around attempting to commit anal rape.
Fortunately, the victim had the presence of mind to quickly grab his phone and frantically dial '110' (the emergency number in Taiwan). On seeing the man calling the police, the Indian man panicked, put his trousers back on, and fled. The assaulted man chased him downstairs and blocked the door, then sent a voice message to a group for help. A roommate, Mr. Ke, quickly arrived and called the police. Police later found two condoms left behind by the Indian man at the scene, suspected to have been prepared in advance for the crime.
During the Kaohsiung District Court trial, the Indian man claimed he was drunk and could not remember anything. However, the judge, upon examining surveillance footage, found that the Indian man was seen fixing his hair in the elevator mirror, appearing sober, and did not believe his claims. He was sentenced to 8 years and 6 months in prison for breaking and entering and forced intercourse, and he will be deported after serving his sentence.
The prosecution appealed, arguing the Indian man should face 12 years in prison. However, the Kaohsiung High Court panel, after reviewing the case, felt the first trial's sentencing was appropriate and proportionate, so it upheld the original sentence of 8 years and 6 months in prison, and ordered deportation after serving the sentence or if pardoned. The case can still be appealed.
