Father Insists on Burial, Mother Hopes for Cremation: Parents Take Son's Funeral Dispute to Court

A teenage boy in the UK has been unable to be laid to rest even after nearly three months since his passing, all because his parents cannot agree on whether he should be buried or cremated. The boy's parents, having different beliefs, have been unable to decide how to say their final goodbye to their son, leading them to bring the matter to court.

According to the Daily Mail, 17-year-old Gabrielle Barbus passed away on December 30, 2025 due to mental health issues. He lived in East London with his mother. His parents separated when he was two and officially divorced in 2013.

However, when it came to arranging Gabrielle's funeral, his parents held completely opposing views. His father, an Orthodox Christian, insisted that his son must be buried to keep his soul intact and allow for future resurrection. In contrast, his mother, who does not adhere to a specific religion, only hoped her son could be cremated and his ashes scattered in the natural environment, so he could "return to the earth."

As the two could not reach an agreement, the father even applied to the court for an injunction to prevent the mother from handling the remains. The case proceeded to the High Court in London and is presided over by Judge Jonathan Klein.

In court, the father emphasized that burial is the last respect for his child. "I’m not trying to win anything, after all, we have already lost our child." His lawyer added that if cremation is ultimately necessary, they hope the ashes can be kept in a fixed location so the family has a place to mourn.

The mother expressed that her son did not grow up in a religious environment and would not want to be "confined in a coffin or urn." She hopes to scatter the ashes in nature, allowing her son to exist in another form. Gabrielle's older brother supports their mother and believes "a cemetery is not a place of rest for us, but a form of constraint." He described his younger brother as someone who loved nature and freedom in life and would not be happy with a burial arrangement.

Since Gabrielle never expressed his wishes regarding his funeral before his death, the case is still under review. The judge also admitted the case is particularly tricky and will strive to make a balanced ruling that satisfies both families.
