After the case of Taiwanese female internet celebrity Hsieh You-hsin was listed as a murder investigation, the Malaysian singer Namewee (Huang Mingzhi), who is involved in the case, has been detained for an additional six days. Taiwanese lawyer Liu Weiting stated that, although the crime occurred in Malaysia, since the victim Hsieh You-hsin held a Taiwan ID card, if Namewee is confirmed to be involved and is sentenced to more than three years, it would be difficult for him to escape prosecution under Taiwan's judicial system.
According to Taiwan's "TVBS News," lawyer Liu Weiting analyzed the case on Facebook and listed three key points:
1) According to Taiwan law, foreigners who commit a crime against a Taiwan national outside of Taiwan with a minimum sentence of three years, the Taiwanese judicial authorities have criminal jurisdiction.
2) Even if the same criminal act has already been tried or sentenced abroad, Taiwan's judicial authorities can still prosecute and try the case independently, but will take into account the time the defendant has served abroad.
3) If it involves homicide, the most severe penalty under Taiwanese law is the death penalty.
Lawyer Liu Weiting further explained that if the final conviction is murder, even if Namewee has served his sentence, it does not mean the case is closed, as Taiwan's judicial authorities can still request extradition from Malaysia. Once Namewee enters Taiwan, judicial action can be taken in accordance with the law, because justice is not bound by location.
If Namewee is involved in feeding drugs, under Taiwan's "Narcotics Hazard Prevention Act", he faces imprisonment of 1 to 7 years. If it involves inducing another person to use schedule 2 narcotics or mixing multiple types of narcotics, the sentence can be increased by half.
