US Appeals Court: Trump Tariff Policy Can Remain in Effect During Litigation

(US, 11th) The US Federal Appeals Court has ruled that during the review of a lower court's decision, which blocked Trump's tariff determination on the grounds of overstepping authority, these tariff measures can remain in effect.
 On May 28, the US Court of International Trade ruled that most of Trump's tariffs were illegal, but the judgment was stayed by the Federal Circuit Court of Appeals. On Monday (June 9th), the US Department of Justice requested the latter to extend the stay period.
 According to Reuters, the Federal Circuit Court of Appeals in Washington, D.C., issued this ruling on Tuesday (10th). This means that Trump can temporarily continue to enforce tariff measures on most trade partners, as well as separately imposed tariffs on Canada, China, and Mexico.
 The Appeals Court has not yet ruled whether these tariff policies comply with the International Emergency Economic Powers Act cited by Trump, but it allows them to remain in effect during the litigation period.
 This law is intended to address "unusual and extraordinary" threats in times of national emergency. The US Court of International Trade's ruling found that Trump's tariff measures exceeded the powers granted to the president by this law. In the application submitted to the Appeals Court, the Trump administration pointed out that the International Trade Court's ruling harms the president's ability to conduct foreign policy.
 The Appeals Court's decision will not affect other tariffs imposed based on more traditional laws, such as those on imported steel and aluminum products.
