(Bandar Seri Begawan, 17th) The Labour Department’s enforcement unit recently conducted Operation "No. 193/2025" at Kampong Limbar residential area, aiming to strengthen enforcement and ensure that employers comply with relevant provisions of the Employment Order (Chapter 278).
During the inspection, enforcement officers checked a foreign worker who was performing lawn mowing duties and uncovered four violations of the Employment Order. Preliminary investigations indicate that both the employer and the employee were possibly involved in these violations.
One of the violations was recorded under Section 10 of the Employment Order, as the employer failed to provide a written employment contract. The other three violations were recorded under Section 112(2), involving breaches of the conditions of a foreign employee license.
The violations included having a foreign worker engage in work that does not match the job specified on their license (such as lawn mowing), the employer’s failure to provide an appropriate job position for the sponsored employee, and the foreign worker being found working independently.
The Labour Department stated that further investigations will be conducted into the above violations under the Employment Order (Chapter 278). If the employer is found guilty, each offence is subject to a maximum fine of BND 1,000. If the fine is not paid within the stipulated time, the relevant employer will be prosecuted in court.
The department reminds all employers to strictly adhere to the relevant provisions of the Employment Order and to pay close attention to the welfare and employment status of their employees, including signing written employment contracts, ensuring that sponsored employees only engage in approved positions, and strictly prohibiting foreign workers from working independently.
