(Kuching, 23rd) A man, jealous that his ex-wife had found a new boyfriend, angrily smashed her smartphone and was fined RM6,000 by the Kuching Sessions Court, or face 12 months in prison as an alternative.
The 36-year-old Gerald Gawan Entalang, from Landeh, pleaded guilty under Section 427 of the Penal Code (intentional damage to property) when charged in court. The case was presided over by Magistrate Ling Hui Chuan.
According to the charge, he was accused of intentionally damaging an iPhone worth RM5,000 belonging to his 35-year-old ex-wife at 8:57 PM on July 3, inside a house in Kampung Laruh Skim.
The facts state that on the day of the incident, the defendant went to his ex-wife’s home to question her about her alleged infidelity during their marriage.
While they were talking, his ex-wife’s phone rang several times but she did not answer. The defendant then asked her to answer, and she handed the phone to him.
He then discovered the caller was his ex-wife’s new boyfriend, which made him furious. An intense argument followed, after which the defendant heavily smashed the phone onto the tarmac, causing it to break.
The incident was triggered by the defendant’s jealousy and resentment over his ex-wife’s infidelity during their marriage, which ultimately led to their divorce.
