Fadillah: 19 MA63 Matters Resolved, Most Issues Have Seen Progress

(Kuching, 8th) Deputy Prime Minister Datuk Seri Fadillah Yusof announced yesterday that, as of now, a total of 19 matters under the Malaysia Agreement 1963 (MA63) framework have been resolved.
According to Malaysiakini (FMT), Fadillah, who is also the Chairman of the MA63 Implementation Action Council, pointed out that one significant achievement was the transfer of Sabah Electricity Sdn Bhd to the Sabah state government via the Sabah Energy Commission.
He made this announcement at the closing public dialogue of the “Rancakkan Madani Bersama Malaysiaku” event held in Putrajaya.

However, Fadillah also noted that due to differences in legal interpretation, a number of issues have yet to be resolved, especially those involving divergences between the Federal Constitution and state laws.
He said: "Since these are legal matters, the views at the state level may differ from those at the federal level, so it's not easy to resolve. However, most of the MA63 matters have been handled."
At the same event, Fadillah also confirmed that these 19 matters were resolved during the current Madani government’s tenure, while the previous federal administration only handled four of them.

Although he did not list all 19 matters on that day, he had previously, on September 12 at a media briefing in Kuching, revealed 9 matters resolved during the Madani government's tenure, including:
1) Recognising the Sabah and Sarawak Public Works Department (PWD) and Department of Irrigation and Drainage (DID) as technical agencies under Treasury Instruction No. 182 (AP182);
2) Amending the Inland Revenue Board Act 1995 to include Sabah and Sarawak representatives as permanent directors on the board;
3) Decentralising regulation of natural gas supply in Sabah;
4) Administrative management of the judiciary in Sabah and Sarawak;
5) Formulating special guidelines for the reacquisition of federal reserve land in Sabah and Sarawak;
6) Decentralising power supply regulation to the Sabah state government;
7) Proposing amendments to Article 95B of the Federal Constitution regarding the division of legislative powers for Sabah and Sarawak;
8) Amending Sabah and Sarawak labour laws;
9) Changing the status of Bintulu Port from a federal port to a state port.
As for the four matters resolved under the previous federal government, they include, during Tan Sri Muhyiddin’s tenure as prime minister, the transfer of liquefied petroleum gas (LPG) regulatory power to Sarawak; and during Datuk Seri Ismail Sabri’s premiership, the amendment of Article 1(2) and 160(2) of the Federal Constitution, granting Sabah and Sarawak rights over deep-sea fishing and licensing, and transferring administrative control over Sipadan and Ligitan Islands to the Sabah state government.
