Trump’s Executive Order Restricting 'Birthright Citizenship' Halted by Federal Judge

On June 10 local time, U.S. District Judge Laplante of New Hampshire ruled to halt the Trump administration’s executive order issued in January aiming to restrict 'birthright citizenship.'

According to China News Service, the policy of 'birthright citizenship' has existed in the United States for more than 100 years, ensuring that everyone born in the U.S. is granted citizenship regardless of their parents’ status. On his first day in office, January 20 this year, Trump signed an executive order abolishing 'birthright citizenship,' stipulating that newborns whose parents are neither U.S. citizens nor lawful permanent residents would not automatically receive U.S. citizenship. This executive order has triggered a series of legal challenges.

Laplante stated that 'depriving birthright citizenship would cause irreparable harm.' He announced a 'preliminary injunction' that would be delayed for seven days, during which the Trump administration can file an appeal.

The plaintiffs’ attorneys said that the Trump administration’s executive order restricting 'birthright citizenship' is 'illegal, unconstitutional, and cruel,' and that Laplante’s ruling would 'protect every child in this country.'

Previously, federal district judges in Maryland, Washington State, and Massachusetts had all issued nationwide injunctions preventing the executive order from taking effect.

On June 27, the U.S. Supreme Court ruled that federal district judges do not have the authority to issue nationwide injunctions to stop the executive order’s implementation.

According to U.S. media reports, Laplante's ruling took advantage of an exception in the Supreme Court’s decision, which allows judges in class action cases to continue blocking Trump administration executive orders nationwide.
