The Judicial Commissioner allowed the prosecution to appeal the judgment against the defendant, Habandi, overturning the initial 8-month imprisonment sentence and replacing it with a 12-month imprisonment sentence.
The Deputy Prosecutor argued that the High Court judge failed to adequately consider the aggravating factors of the case. These factors included the repeated touching of the victim's body while she was trapped alone in the defendant's vehicle.
The prosecution also emphasized the psychological harm suffered by the victim.
