China has implemented export controls on technologies related to rare earth mining, refining and separation, magnet material manufacturing, and secondary resource recycling.
According to an announcement on the Ministry of Commerce of China's website on the 9th, in order to safeguard national security and interests, it has been decided that, effective immediately, export controls will be enforced on rare earth related technologies and other items.
The regulations specify that technologies and their carriers related to rare earth mining, refining and separation, metal smelting, magnet material manufacturing, and secondary resource recycling, as well as related production line assembly, commissioning, maintenance, repair, and upgrading, may not be exported without permission.
If exporters are aware that goods, technologies or services not subject to control are being used for or will substantially contribute to overseas rare earth mining, refining and separation, metal smelting, magnet material manufacturing, or secondary resource recycling activities, they must apply for a dual-use item export license from the Ministry of Commerce before export. Export without permission is not allowed.
The announcement states that exporters should apply for export licenses from the Ministry of Commerce in accordance with Article 16 of the "Regulations of the People’s Republic of China on the Administration of the Export of Dual-Use Items and Technologies".
No organizations or individuals may provide intermediary, brokerage, agency, freight, delivery, customs declaration, third-party e-commerce platforms, financial or other services for activities that violate this announcement. Chinese citizens, legal persons and unincorporated organizations may not, without approval, provide any substantive assistance or support to overseas rare earth mining, refining and separation, metal smelting, magnet material manufacturing, or secondary resource recycling activities.
