Agitated Assault on Female Driver, Denies Intentional Harm Charge

A military personnel accused of assaulting a female driver after his wife and daughter were hit by a car pleaded not guilty to an intentional harm charge in the Seremban magistrate’s court on Monday (April 7). He was granted bail at RM2000 pending trial.

The accused, Abdul Hafiz (35), was charged with assaulting the victim, Shairah (28), at 10:20 PM on March 29 at Taman Satria, Senawang, Negeri Sembilan.

This case is prosecuted under Section 323 of the Penal Code (intentional harm), which carries a maximum penalty of one year imprisonment or a fine not exceeding RM2000, or both, upon conviction.

Deputy Public Prosecutor Nadia recommended the court to approve bail at RM2000, whereas the accused’s defense lawyer, Krishan Dee Rai from the National Legal Aid Foundation, requested a reduction in bail due to his client needing to support two young children and care for elderly parents.

Magistrate Saif Farid ultimately set bail at RM2000 with one surety and scheduled the case for mention on May 19.

Reportedly, the incident occurred when the woman was driving her car and failed to avoid the accused’s wife and 7-year-old daughter crossing the road, causing minor injuries to both. The accused, allegedly dissatisfied, resorted to violence, causing the female driver bruising on the right rib and swelling at the back of her head. The police subsequently arrested the man and commenced an investigation.
