(Kuching, 15th) A businessman has been granted a Discharge Amounting to an Acquittal (DAA) by the Kuching Magistrate's Court after the prosecution decided not to proceed with the case against him for drink-driving. This means that he has essentially been acquitted of the charge.
28-year-old Edisson Kho Tuo Shen was granted the DAA by Magistrate Nursyaheeqa Nazwa Radzali on Tuesday (July 14th).
According to the charge, Kho Tuo Shen was accused of driving with a blood alcohol level exceeding the legal limit on October 13, 2022, on Jalan Simpang Tiga, Kuching, in violation of Section 45A(1) of the Road Transport Act 1987.
If convicted, he could have faced up to two years’ imprisonment, a fine between RM10,000 to RM30,000, and at least a two-year disqualification from holding or applying for a driver's license.
During the proceedings, the defense pointed out that the case had been pending in court for nearly four years since the alleged offense.
Although multiple trial dates had been set, the trial was repeatedly postponed and had yet to officially commence.
The defense argued that the charge should not remain indefinitely unresolved and requested the court to grant the defendant a DAA.
The prosecution, represented by Deputy Public Prosecutor Muhammad Aidil Akmal Sharidan, informed the court that they did not intend to continue with the case.
Ultimately, the magistrate granted Edisson Kho Tuo Shen a Discharge Amounting to an Acquittal.
